GENERAL TERMS AND CONDITIONS OF TINY RIO
These General Terms and Conditions (“GTC”) apply to the entire business area of TINY RIO GmbH (hereinafter “Company”). TINY RIO GmbH sells used children's clothing.
TINY RIO GmbH, located at Avenue du Léman 56, 1005 Lausanne, Switzerland, registered in the Commercial Register of the canton de Vaud under the number CHE-494.284.686. You can contact us at hello@tinyrio.ch.
There terms apply to all users of the domain tinyrio.ch. The terms and conditions will be valid for all your future transactions with TINY RIO (TINY RIO my be referred to as "the company" or "us") and visits to the site. We reserve the right to revise there terms and conditions. The date of the latest update is found in the final section of the terms and conditions. Users are responsible for keeping themselves updated with such changes.

A. GENERAL
1. DATA
The company may process and use the data recorded as part of the conclusion of the contract to fulfill the obligations arising from the contract. The company takes the measures necessary to secure the data in accordance with legal regulations. The customer fully agrees to the storage and contractual use of his data by the company and is aware that the company is obliged and entitled to disclose information from the customer to them or third parties upon order of courts or authorities. If the customer has not expressly prohibited this, the company may use the data for marketing purposes. The data necessary to fulfill the service can also be passed on to commissioned service partners or other third parties.
2. CHANGES
These general terms and conditions may be changed by the company at any time. In principle, the version of the General Terms and Conditions that is in force at the time the contract is concluded applies to customers. Unless the customer has agreed to a newer version of the General Terms and Conditions.
3. PRIORITY
These General Terms and Conditions take precedence over all older provisions and contracts. Only provisions from individual contracts that specify the provisions of these General Terms and Conditions take precedence over these General Terms and Conditions.
4. SEVERABILITY CLAUSE
Should a provision of this contract or an attachment to this contract be or become invalid, this will not affect the validity of the rest of the contract. The contracting parties will replace the invalid provision with an effective provision that comes as close as possible to the intended economic purpose of the invalid provision. The same also applies to any contractual gaps.
5. APPLICABLE LAW & PLACE OF JURISDICTION
These general terms and conditions are subject to Swiss law. Unless there are mandatory legal provisions, the court at the company's registered office is responsible. The company is free to file a lawsuit at the customer's registered office. The United Nations Convention on Contracts for the International Sale of Products (SR 0.221.211.1) is explicitly excluded.
6. VIOLATION OF RULES
The company reserves the right to seek all solutions available at law and in equity for violations of these terms and conditions, including the right to block access to the site. Individuals violating the restriction of password-protected areas of the site may be subject to prosecution.
7. LINKS
The site may contain links to other websites beyond our reach. We cannot be held liable for content or privacy policies of such sites.
B. BUYING
1. CLOTHING CONDITION
All items have been carefully washed, and are going through quality control. We promise a careful check of everything sold on TINY RIO. The clothes are washed and ironed before being offered on sale on our web shop. As you are buying second-hand clothing, a detailed description of the item is present on every product sheet. We cannot guarantee that the colors on the website will be true to life. This depends partly on the color settings of your device.
2. CONCLUSION OF CONTRACT
The conclusion of the contract comes about through the customer's acceptance of the company's offer regarding the purchase of products. The contract is concluded in any case when the customer orders the products offered by the company via the company's online shop or buys them directly. If a product is placed in the shopping cart, the product will be reserved for the customer for 30 minutes. After this period, the product will be released for sale again.
3. PRICES
Unless otherwise offered, all prices are in Swiss francs (CHF). All prices include any applicable value added tax (VAT). The prices are exclusive of any other applicable taxes. The prices do not include shipping costs. The shipping costs are CHF 9.00. For purchases worth CHF 75.- or more, delivery is free of charge. The company reserves the right to change prices at any time. The prices valid at the time of conclusion of the contract on the company's website apply.
4. PAYMENT
You can pay your order using the payment methods available on www.tinyrio.ch (credit card), and via the secure payment platform of Shopify Payments. Payment for all orders is accepted exclusively in Swiss francs. When paying you guarantee that you have the authorizations that may be necessary to use the payment method chosen by you.
5. OBLIGATIONS OF THE COMPANY
5.1 DELIVERY / DELIVERY DATES
Delivery usually takes place within 2 to 4 working days after receipt of the order. If delivery on time is not possible, the customer will be informed by the company within 2 working days of receipt of the order, and the new delivery date will be communicated. Unless otherwise agreed, the place of performance is agreed to be the company's registered office. The company fulfils the obligation by handing over the ordered products to the agreed carrier.
5.2 AUXILIARY PERSONS
The parties have the express right to call in auxiliary persons to carry out their contractual obligations. You must ensure that the assistance of the assistant is in compliance with all mandatory legal provisions and any collective employment agreements.
6. ORDER CANCELLATION
The order can be canceled up to 2 hours after receipt of the order. We invite you to use our contact form for your request.
7. RETURNS
Unfortunately, we cannot take back second hand clothing as it is difficult to find out whether the item of clothing has already been worn - after all, this item has already been used before. We therefore attach a great importance to describe the products very precisely so that no incorrect orders are placed, and you receive exactly what you expect. We thank you very much for your understanding !
8. WARRANTY
Especially since these are second-hand items, the warranty is expressly and completely excluded.
9. LIABILITY
Liability for any indirect damage and consequential damage is completely excluded.
Liability for direct damages is limited to the sales price of the product. This limitation of liability does not apply to direct damage caused by gross negligence or intent. The customer is obliged to report any damage to the company immediately.
Any liability for assistants is completely excluded.
10. FORCE MAJEURE
If timely fulfillment by the company, its suppliers or engaged third parties is prevented as a result of force majeure such as natural disasters, earthquakes, volcanic eruptions, avalanches, severe weather, thunderstorms, storms, wars, unrest, civil wars, revolutions and uprisings, terrorism, sabotage, Strikes, nuclear accidents, etc. If reactor damage is impossible, the company is released from fulfilling the affected obligations for the duration of the force majeure and a reasonable start-up time after it ends. If the force majeure lasts longer than 30 (thirty) days, the company can withdraw from the contract. The company must fully reimburse the customer for any fees already paid. Any further claims, in particular claims for damages as a result of vis major, are excluded.
C. GIVEAWAYS AND CONTESTS
As part of its promotional activities, TINY RIO occasionally organizes contests on its official Instagram account @_tinyrio.
1. PARTICIPATION REQUIREMENTS
Participation in these contests is open to any individual of legal age residing in Switzerland. To participate, users must follow the instructions outlined in the contest post.
2. WINNER SELECTION
The winner will be selected either by random draw or according to the criteria specified in the contest post. The winner’s name will be announced via a post or story on the Instagram account @_tinyrio and will also be contacted via private message on Instagram.
3. PRIZES AND PRIZE DELIVERY
The prizes offered are specified in the contest post. Prizes are non-exchangeable and cannot be redeemed for cash or store credit.
TINY RIO commits to sending the prize within 7 (seven) days after the winner's announcement, provided that the winner submits their complete contact details within 48 (forty eight) hours of being notified. Certain conditions may apply to the prize, such as a minimum purchase requirement or non-combinable discount vouchers, if applicable. These details will be communicated to the winner in the private message.
4. LIABILITY
TINY RIO cannot be held responsible for any technical issues that may prevent participation or prize delivery. Instagram is neither the organizer nor a sponsor of the contest.
5. ACCEPTANCE OF THE RULES
Participation in the contest implies full acceptance of these terms and of the specific rules detailed in each contest post.
